Default Road Glide innerfairing problem

I had to have my innerfairing replaced after an accident. When I got he bike back I found a 1 1/2 gap between the inner and outterfairing at the top. The factory fix was foam tape on the wind shield whice I find unaceptable. I was replaced again and still the same problem. The factory blames the dealer and vise- versa, I have talked the the factory several thmes and they want history, the deler told me that they have had this problem since 04. any info would help, they want history they will get it everyday when I call them.
